Kloutforce, Inc. (“Kloutforce”, “we”, “us”, or “our”) respects your privacy and is committed to protecting your personal data. This Privacy Policy explains what personal information we collect, how we use it, who we share it with, and the choices you have. It applies to information collected through our website (kloutforce.com), our creator and brand dashboards (Koordinator, Katalog), investor portals, mobile web experiences, and any other services we offer (collectively, the “Services”).

1. Summary — The short version
We collect basic account, contact, and profile information so creators, brands and customers can use Kloutforce.
For investors and creators we may collect KYC documents, tax forms (W-9/W-8 family), and payment information.
We use third-party payment processors (e.g., banks, Wise), DocuSign, and KYC providers to process payments and verify identity — we do not store full card numbers on our servers.
You can access, correct, or request deletion of your personal data (subject to legal exceptions).
We retain records for as long as necessary for operations, compliance, and tax reporting.
We may update this policy; material changes will be posted with a new effective date.
2. Information we collect
We collect information that is necessary to provide the Services and to comply with legal and payment obligations. The categories below show the typical data we collect from different users.
A. Account & profile information
Full name, display name, username, biography, profile photo
Email address, phone number, country of residence
Social handles and public profile links (Instagram, TikTok, YouTube, Twitter, etc.)
B. Transaction & payment information
Payment amounts, currency, dates, and transaction IDs
Payment routing information for transfers (bank account, routing number, Wise account details) — typically provided by you or obtained via our payment partners
Payment processor reference IDs and reconciliation receipts
C. KYC & compliance information (for creators, brands, and investors)
Government-issued photo ID (passport, national ID, driver’s license) — images or scans
Proof of address (bank statement, utility bill)
Tax documentation (W-9 for U.S. persons; W-8BEN/W-8BEN-E or other W-8 forms for non-U.S. persons)
Entity documentation for corporate investors (certificate of formation, articles, beneficial owner info)
Source-of-funds documents if requested (bank statements, sale agreements)

Catalog items you create, product selections, commission settings, and public catalog pages

3. How we collect information
Directly from you. When you create an account, subscribe, upload documentation, sign agreements via DocuSign, or contact support.
From third parties. Payment processors (bank, Wise, Stripe), identity verification/KYC vendors (e.g., Jumio, Onfido, Sumsub — if used), analytics providers, and social networks (when you link an account).
Automatically. Through cookies, server logs, and standard analytics tools when you interact with our Services.
4. How we use your information
We use your data to operate and improve the Services and to meet legal obligations:
Core uses
Create, manage, and secure your account and profile.
Provide the Services (enable catalogs, process payments, calculate and disburse commissions, manage deals).
Verify identity and comply with AML/KYC, tax, and anti-fraud obligations.
Process and reconcile payments and issue tax documents as required by law.

5. Who we share information with
We share information with third parties strictly as needed to deliver the Services or comply with law:

Limited sharing rules
We do not sell personal data. We may share aggregated or de-identified data that cannot reasonably be linked to any individual for analytics or research.
We will only provide investor KYC/tax data to banks, payment partners and legal advisors as required to process investments and comply with law.
6. Payments, tax forms & investor data
You may provide payment routing (bank account or Wise details) to receive payouts; we share these with banks and payment processors to effect transfers.
For investor onboarding and compliance we will collect KYC and tax documents (W-9/W-8). These are required for legal and tax reporting (including U.S. withholding obligations).
We store minimal tax / withholding information necessary to comply with tax laws and filing obligations. We may share W-9/W-8 information with taxing authorities, banks, and payment processors for reporting and compliance.
7. Cookies, tracking & advertising
We use cookies and similar technologies to provide and improve the Services, remember preferences, and analyze usage. You can control cookies via your browser settings; note that disabling cookies may affect functionality.
We may use analytics providers (Google Analytics or similar) to measure and improve our Services. Where legal requirements apply, you will be presented with a cookie notice and can opt out of non-essential cookies.
8. Data retention & deletion
We retain personal data as long as necessary to provide the Services, to comply with legal obligations (accounting, tax, KYC recordkeeping), and to resolve disputes. Typical minimum retention for financial and KYC records is several years depending on jurisdiction (e.g., 5–7 years).
You may request deletion of your personal data by contacting privacy@kloutforce.com. We will honor deletion requests except where retention is required by law, for legitimate business interests (e.g., fraud prevention), or to preserve contractual or tax obligations. When deletion is possible, we will remove the data from active systems and anonymize records used for analytics or legal compliance.
9. Your rights and choices
Depending on your jurisdiction you may have rights to:

Request deletion of your personal data (subject to legal exceptions).

11. Minors
Our Services are intended for users 18 or older. We do not knowingly collect personal information from children under 16 (or a higher age depending on local law). Kloutforce operates globally. Personal data may be transferred to, processed in, or stored in countries other than your country of residence (including the U.S.). User-generated content (catalogs, comments) is public or shared based on your settings — do not include sensitive personal information in public content.
